A 50 años de la promulgación de la ley 20.247 de Semillas y Creaciones Fitogenéticas - Análisis de fortalezas, debilidades, carencias y futuros desafíos (50 Years After the Promulgation of Law 20,247 on Seeds and Plant Varieties – Analysis of Strengths, Weaknesses, Shortcomings, and Future Challenges)

English Abstract: The objective of this paper is to recapitulate the history of Law 20,247 on Seeds and Plant Varieties of Argentina 50 years after its enactment. The paper highlights the origin of the law as a pioneering and advanced legal framework in the region, which still retains sufficient entity in regarding the seed trade. On the contrary, the reasons why this legal instrument has been gradually losing relevance in institutional aspects and in almost everything related to the intellectual property of plant varieties, mainly due to the incessant scientific and technological advancement in plant breeding, are analyzed. Likewise, in the same sense, the situation of the UPOV Convention is discussed, along with the challenges posed by this international treaty
