Innovation, Entrepreneurship, and the Law

In this second version of this working paper, Emile Loza discusses the need to conceptualize innovation as a market system and identifies some of the actors, types of capital, and legal infrastructure needed to accelerate the deployment of innovation and improve the sustainability of innovators. She addresses entrepreneurs as those market actors who drive innovation and bring it to fruition. Loza also discusses rule of law failures and lack of legal coordination as contributing to the inefficient and ineffective operation of innovation markets and, ultimately, to their lack of sustainability. From the most recent earlier version of this paper, dated June 27, 2010, Loza expands upon the types of capital needed for pursue innovation-driven entrepreneurial enterprises. She adds a beginning discussion of the profound lack of legal capital in these enterprises and posits an under-supply of competent legal providers capable of representing technology businesses operating in global markets to the level required by professional codes of conduct. She also begins the process of adding citations to source material, using long cites until the work is completed
